The European Commission has proposed to launch a single digital declaration portal for businesses providing services and temporarily sending employees to another Member State, known as ‘posted workers’. The EU Single Market estimates 5 million posted workers. One of the major administrative barriers faced by their employers is to manage multiple and diverse documentation in each Member State.

As reported by the EU Commission, Member States will be able to utilise the public interface voluntarily. In the Member States that decide to do so, the new single digital declaration portal will ease the administrative cost for businesses when assigning their workers abroad.

This will contribute to the Commission’s purpose of facilitating companies’ reporting burden by 25%, as outlined in its Communication on ‘Long-term competitiveness of the EU’, while fully supporting the existing high-level security of rights of posted workers enshrined in EU and national legislation.
How does the portal simplify cross-border worker compliance?
The proposal will also permit better compliance with existing regulations, permitting the enforcement of fair mobility, in line with high worker safety standards. According to the EU Commission, the tool proposed will reduce the administrative burden for posting workers: A single digital declaration portal will permit service providers to use a single form instead of using 27 different national forms.
What compliance benefits does the eu portal offer?
It will enhance collaboration among Member States: The new portal will be part of the Internal Market Information System (IMI). Member States are already operating IMI today when launching requests for information or requesting mutual help to monitor compliance with the rules on posting of workers. Moreover, it will support the protection of workers: The simplification of the procedure of submitting and updating posting declarations will decrease cases of non-compliance with posting rules and improve the transparency of postings. It will reduce the carrying out of effective and targeted reviews by the Member States, contributing to the protection of posted workers’ rights.
